Terms of Service

By accessing or using the Home Index platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

These terms constitute a legally binding agreement between you and Up Your Bids LLC (d/b/a Home Index). Your continued use of the service constitutes acceptance of any modifications to these terms.

Home Index is an online marketplace platform that connects homeowners seeking home repair, improvement, and maintenance services with licensed and qualified vendors (contractors, tradespeople, and service providers). We facilitate the bidding process, communication, and transaction management but are not a party to the actual service agreements between homeowners and vendors.

Our platform provides tools for project posting, bid submission, vendor communication, payment processing, vendor verification, project management, and AI-assisted features. We may modify, suspend, or discontinue any aspect of the service at any time.

Account Creation

To use our services, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.

User Roles

Users may register as homeowners (buyers), vendors (contractors/service providers), or both. Your access to platform features depends on your registered role(s). You may hold multiple roles on a single account.

Account Verification

We may require verification of your identity, business registration, licensing, insurance, or other credentials before full access to certain features is granted.

Account Suspension

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or pose a risk to other users.

Vendor Verification

Home Index offers a voluntary vendor verification program. Through this program, we attempt to confirm certain information provided by vendors, which may include business licensing, insurance coverage, and other credentials. Verification indicates only that the vendor has submitted documentation that we have reviewed at the time of verification. It does NOT constitute an endorsement, guarantee, or warranty of the vendor's qualifications, workmanship, reliability, financial stability, or fitness for any particular project.

Project Verification

Home Index may verify certain aspects of posted projects, including confirming homeowner identity and basic project details. Project verification indicates only that we have reviewed the information provided to us. It does NOT constitute a guarantee of the accuracy, completeness, or feasibility of any project listing, nor does it guarantee the availability of funding, the scope of work described, or the homeowner's ability to fulfill their obligations.

No Guarantee of Accuracy

Verification is based on information available to us at the time of review and may not reflect subsequent changes in a vendor's licensing status, insurance coverage, business standing, or other credentials. We do not continuously monitor verified vendors or projects. Users are solely responsible for conducting their own due diligence before entering into any service agreement.

Limitation of Liability for Verification

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOME INDEX AND UP YOUR BIDS LLC SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR CLAIMS ARISING FROM OR RELATED TO RELIANCE ON ANY VERIFICATION STATUS DISPLAYED ON THE PLATFORM. This includes, without limitation, damages arising from a verified vendor's failure to perform, poor workmanship, misrepresentation, lapsed credentials, or any other act or omission. Verification is provided as a convenience and informational tool only, and users rely on it at their own risk.

Background Checks

As part of the verification process, we may conduct background checks on vendors through third-party providers in compliance with the Fair Credit Reporting Act (FCRA). Background check results are one factor in our verification process and do not guarantee future conduct. Vendors consent to background checks as part of the verification enrollment process.

Use of Artificial Intelligence

Home Index uses artificial intelligence (AI) and machine learning technologies to enhance platform functionality. AI-powered features include, but are not limited to: analysis of inspection reports and project photos, automated bid comparison and analysis, vendor-project matching, content generation, market research, and email communications. AI features are powered by third-party AI providers including Anthropic and OpenAI.

AI-Generated Content

Certain content on the platform, including but not limited to project descriptions derived from inspection reports, bid analyses, vendor profile summaries, blog posts, cost guides, and email communications, may be generated or assisted by AI. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. Users should independently verify any AI-generated information before relying on it for decision-making.

Automated Decision-Making

Our platform uses automated systems for vendor-project matching, bid analysis scoring, vendor rating calculations, and emergency project routing. These automated processes assist in platform operations but do not replace human judgment for critical decisions. Users may contact us to request human review of any automated decision that materially affects them.

Data Processing by AI

When you submit project descriptions, photos, inspection reports, bids, or other content to the platform, this data may be processed by third-party AI services for analysis, matching, and platform improvement. By using the platform, you consent to this processing. See our Privacy Policy for more details on how your data is handled.

Public Data Collection

Home Index may collect publicly available information about vendors and service providers from third-party sources, including but not limited to business directories, review platforms, public records, and vendor websites. This information may be used to create or supplement vendor profiles on our platform.

Vendor-Created Profiles vs. Platform-Generated Profiles

Vendor profiles on the platform may be created directly by vendors or generated by the platform using publicly available information. Platform-generated profiles are clearly distinguished from vendor-claimed profiles. Vendors may claim, update, or request removal of their profiles at any time by contacting us.

Vendor Rating System

Home Index maintains a proprietary vendor rating system that evaluates vendors based on factors including online reputation, licensing and insurance status, years in business, platform performance, and profile completeness. Ratings are provided for informational purposes only and do not constitute an endorsement or guarantee. The specific methodology and weighting of rating factors are proprietary and subject to change.

Consent to Receive Text Messages

By submitting your phone number when creating an account and opting in to SMS communications, you agree to receive text messages about project opportunities, bid updates, and account notifications from Home Index. Message and data rates may apply. Message frequency varies.

Opting Out

You may opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive a confirmation message and will no longer receive SMS communications from Home Index.

Supported Carriers

Text messaging is available on most major carriers. Home Index is not responsible for delayed or undelivered messages due to carrier issues or device settings.

Automated Phone Calls

Home Index may use automated calling systems to contact vendors regarding platform opportunities, account setup, and service-related matters. By providing your phone number and registering as a vendor, you consent to receive automated calls during reasonable business hours in your local time zone. You may opt out of automated calls at any time by notifying us.

Email Communications

We may send automated email communications regarding platform activity, project opportunities, and service announcements. Some email communications may be AI-generated. All marketing emails include an unsubscribe option. Transactional emails related to your account activity may not be opted out of while your account remains active.

Push Notifications

Our mobile application may send push notifications for project updates, bid activity, and other platform events. You can manage push notification preferences in your device settings or within the app.

SMS/MMS Project Creation

Home Index offers a concierge service that allows homeowners to create projects by sending text messages and photos to our platform. Photos and descriptions submitted via SMS/MMS are analyzed using AI to extract project details. By using the concierge service, you consent to AI processing of your submitted photos and text.

Accuracy of AI-Parsed Projects

Projects created through the concierge service are based on AI interpretation of submitted photos and descriptions. While we strive for accuracy, AI-generated project details may require review and correction. All concierge-submitted projects undergo administrative review before being published on the platform.

Emergency Project Listings

Homeowners may designate projects as emergencies for urgent repair needs. Emergency projects have shortened bidding windows (as little as 4 hours for critical severity) and accelerated vendor notification cycles.

Emergency Vendor Notifications

Vendors who opt in to emergency availability may receive notifications outside of standard business hours, including 24/7 for critical-severity emergencies. By opting in to emergency availability, vendors consent to receiving time-sensitive notifications at any hour.

No Guaranteed Response

Home Index does not guarantee that emergency projects will receive bids or that vendors will be available. Emergency designation is a prioritization tool and does not create any obligation on the part of Home Index to ensure project completion.

Accurate Information

You must provide accurate and truthful information in all project descriptions, bids, and profile information. Misrepresentation may result in account termination.

Professional Conduct

You agree to conduct yourself professionally and courteously when interacting with other users. Harassment, discrimination, or abusive behavior is strictly prohibited.

Compliance with Laws

You must comply with all applicable local, state, federal, and international laws when using our platform and conducting business through it.

Content Ownership

You retain ownership of content you create but grant Home Index a non-exclusive, worldwide, royalty-free license to use, modify, display, and distribute such content in connection with our services and platform operations, including AI processing and analysis.

You may not use the platform to: (a) post false, misleading, or fraudulent content; (b) engage in bid manipulation or collusion; (c) violate intellectual property rights; (d) distribute malware or harmful code; (e) attempt to bypass our fee structure; (f) create multiple accounts to circumvent restrictions; (g) scrape or harvest data from the platform without authorization; (h) interfere with the platform's AI or automated systems.

Any violation of these prohibitions may result in immediate account suspension and legal action.

Verification Subscription

Home Index offers a Verified Vendor subscription at $399 per year. This subscription includes vendor verification services, enhanced profile features, and priority placement. Subscription details and pricing are available on our pricing page and may be updated with notice.

Payment Processing

Payments are processed through Stripe and, for mobile app purchases, through Apple App Store and Google Play. By using payment services, you agree to the applicable terms and conditions of these payment processors. Home Index does not store your full payment card details.

Refunds

Refunds are handled according to our refund policy and may be subject to processing fees. Disputes should be resolved directly between parties when possible.

Tax Responsibility

Users are responsible for all applicable taxes on their transactions. Home Index may collect and remit taxes where required by law.

QuickBooks Integration

Vendors may connect their QuickBooks account to export project data and import estimates. By authorizing this integration, you grant Home Index permission to share relevant project data with Intuit QuickBooks. You may revoke this authorization at any time through your account settings.

Third-Party Services

The platform integrates with various third-party services to provide its functionality, including payment processors, communication providers, analytics services, and AI providers. Your use of the platform constitutes acceptance of data sharing with these service providers as described in our Privacy Policy.

The Home Index platform, including all software, designs, text, graphics, logos, AI models, rating algorithms, and other content, is protected by copyright, trademark, and other intellectual property laws. Home Index is a trademark of Up Your Bids LLC.

You may not reproduce, distribute, modify, or create derivative works of our platform without express written permission.

Service Availability

We strive to maintain high availability but cannot guarantee uninterrupted service. The platform is provided 'as is' and 'as available' without warranties of any kind, express or implied.

No Endorsement of Vendors or Projects

Home Index is a marketplace platform only. We do not employ, endorse, or guarantee any vendor listed on the platform, whether verified or not. We are not responsible for the quality, safety, legality, reliability, or performance of services provided by vendors found through our platform. All service agreements are solely between the homeowner and vendor.

AI Accuracy

AI-powered features, including bid analysis, project parsing, and content generation, are provided as tools to assist users and may contain errors. Home Index is not liable for decisions made based on AI-generated content or recommendations.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UP YOUR BIDS LLC'S TOTAL LIABILITY TO YOU FOR ANY DAMAGES SHALL NOT EXCEED THE AMOUNT OF FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

You agree to indemnify and hold harmless Up Your Bids LLC (d/b/a Home Index), its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these terms, your reliance on any verification status, or any dispute between you and another user of the platform.

Internal Resolution

We encourage users to resolve disputes through our internal dispute resolution process before pursuing legal action.

Arbitration

Any legal disputes arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of South Carolina.

Governing Law

These terms are governed by the laws of the State of South Carolina, without regard to conflict of law principles.

Class Action Waiver

You agree to resolve any disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
